IS THE CONTINOUS DECLARATION OF SoPE IMPEACHABLE OFFENSE?

The President of the republic of the Gambia has since Mach 2020 being declaring State of public declarations, upon another State of Public Emergency in the name of fighting COVID-.19.

The question now is, is the President wanting for violation of  the Constitution, or is he found wanting of a wilful violation of the oath of allegiance, or wilful violation of any provision of the Constitution?

The President do not have any powers to extend any State of Public Emergency; that power is vested in the offices of the National Assembly. That was why after the first declaration was made at the end the President has to come to the National Assembly for an extension; which extension was approved.

However when that 45 days expired the executive came back to the Assembly asking for another extension which extension was rejected by members as the executive could not get the support of three quarters of all members. .

The irony here  is,  since the President lost the confidence of the members of the National Assembly, he did not have the courage to come back to the Assembly for a further extension, and therefore relied on the constructional powers to   keep declaring 21 days upon 21 days as the members of the Assembly were not sitting; the President almost gathered courage to face the Assembly but has to withdrew the Motion even before it was tabled.

The law makers are now demanding that the President come to the National Assembly to provide answers to four key questions:

  1. a) Why the motion for an extension of a state of public emergency for a period of 45 days with effect from Wednesday, 1st July 2020, as per the Order paper of the 30th June 2020, was withdrawn.
  2. b) If the State of Public Emergency been declared since the National Assembly Commence session? If so when was it declared and under what authority.
  3. C) The honourable member asked what Emergency powers Regulations are currently in force and under wat authority.
  4. d) How the executive computes time to determine the expiry date each of the declarations of the State of Public Emergency since 18th March 2020.

How the executive explains themselves; shall determine if he President did flouts the Constitution or not.

Will he be found wanting for am impeachments???
